Consultation Phase
The Parish Council agreed that the pre-submission document, the draft Neighbourhood Plan, should move on to the Consultation phase, a six week period during which interested parties responded with their views on the content of the document. The Plan was circulated widely, including Devon County Council, the Environment Agency, English Heritage and many others.
A Representation Form was provided with the May issue of the Parish Magazine for parishioners to express their views. The Form was available on-line and as hard copy in the Shop and the Information Room. The closing date for responses was 20th June 2016.
The Working Party took into account the comments and Representations received from Parishioners, Landowners and Statutory Consultees during the pre-submission Consultation phase and agreed final amendments to the draft Neighbourhood Plan. On 26th July 2016 the draft Neighbourhood Plan was presented to the Parish Council and unanimously approved to proceed to submission.
The Submission Plan, plus supporting evidence, was sent to EDDC on 20th August 2016 and can be viewed on the EDDC website, together with EDDC's press release.
EDDC was satisfied that the Submission Plan met legislative requirements and publicised it for a six week consultation period from 5th September to 17th October. The purpose of this consultation period was to invite Representations, notify any consultation body referred to in the consultation statement and send the submission Neighbourhood Plan to independent examination.
The consultation period was an opportunity for those wishing to make their views known to the independent examiner to submit written Representations. Representations were intended address whether or not the Submission Neighbourhood Plan met the basic conditions and other matters that the independent examiner is required to consider. Representations may also address whether the referendum area should be extended beyond the neighbourhood area. Anyone who wished to make a case for an oral hearing could do so as part of a written Representation. View a sample of Representation Form.
When a Plan is submitted to a local planning authority the authority is considering the draft plan against statutory requirements. A local planning authority has to be satisfied that a basic condition statement has been submitted but it is not required to consider whether the draft plan meets the basic conditions. It is only after the independent examination has taken place and after the examiner’s report has been received that the local planning authority comes to its formal view on whether the draft Neighbourhood Plan meets the basic conditions.
At this point, the passage of the Plan through the next stages was out of the hands of the Parish Council.
